Shaykh Sulaymān al-‘Alwān (حفظه الله) explains that those wanting to get married:
Cannot speak to each other in seclusion,
And can’t talk over the phone without asking her guardian at home to do so before calling.
“What a suitor can look at is the face, hands and arms, it’s also possible to look at the hair and head, however, whatever is besides this is to prevent from.
Concerning speaking, ya’nī both parties wanting to speak to each other, we said this is under the condition that there’s no seclusion. Likewise, whenever he wants to speak to her over the phone, this is permissible due to wanting to know about her intellect with the condition that her walī grants her permission to do so.
A woman isn’t permitted to talk with him over the phone without seeking the permission of her walī if they haven’t written the marriage contract, rather that’s to be completely prevented and avoided, and no concession is given for that.”
