Hadith: Sahih al-Bukhari 7055, 7056

Do NOT FIGHT against your Authority/Ruler UNLESS there is a CLEAR KUFR, a proof from Allah.

My Critical Reasoning:

How you get the proof from Allah? 

Allah’s word, Quran.

So, does Allah gave us any proof? 

yes,

What is it?

Ayah 5:44 (Whoever doesn’t rule by Allah’s Law, is a Kafir) 

What does this mean? The one who doesn’t believe in Allah and His Rasul, is a Kafir, isn’t that what we know already?

yes, that’s true.

Then what about this Kafir? Does it give us another definition of Kafir?

Good question and very thoughtful. Let’s have a critical reasoning of this. A kafir, who is already a kafir, can he be kafir because he doesn’t rule by Allah’s Law? 

No! A kafir rejects Allah, Rasulullah already. Obviously he won’t follow Allah’s LAW. Therefore, not following Allah’s law cannot be a condition for them, make sense?

Then who Allah talking about in this Ayah? 

Obviously, the Ayah only makes sense when you put ‘Muslim’ ruler in that situation, those ‘Muslims’ who does not rule by Allah’s law and those who choose and enforce kuffar’s law, men-made law over the law of Allah thus they REJECT Allah’s Law and it is the REJECTION of Allah’s law that make them Kafir.

And this is how it makes sense when Mujahideen fight against and kill those ‘Muslims’ ruler (Taghut) who enforced Kuffar’s law and those ‘Muslims’ who associate and support with those Taghut rulers.

Hadith

Narrated Junada bin Abi Umaiya:

We entered upon ‘Ubada bin As-Samit while he was sick. We said, “May Allah make you healthy. Will you tell us a Hadith you heard from the Prophet (ﷺ) and by which Allah may make you benefit?” He said,

“The Prophet (ﷺ) called us and we gave him the Pledge of allegiance for Islam, and among the conditions on which he took the Pledge from us, was that we were to listen and obey (the orders) both at the time when we were active and at the time when we were tired, and at our difficult time and at our ease and to be obedient to the ruler and give him his right even if he did not give us our right, and not to fight against him unless we noticed him having open Kufr (disbelief) for which we would have a proof with us from Allah.”
